ASSUMPTION, LIABILITIES AND LIMITING CONDITIONS
The appraiser has no present or contemplated future interest in the
subject property. This appraisal is not an offer to buy, sell or
broker the sale of the item described.
Fees charged for this appraisal are based solely on the length of time
expended in appraising the subject property and are in no way related
to the value of the property involved.
The appraisal should not be relied upon as the basis for purchase or
sale of the item described. It is solely an estimate of value of the
subject property at the time and place of the appraisal. Therefore, no
liability is assumed as to contractual liability or damages with
respect to any legal action initiated as a result of reliance on the
information contained herein.
It is understood that the fees paid for this appraisal do not include
services of the appraiser in any other manner capacity whatsoever.
Ancillary services required by the property owner are to be retained
separately. In particular, statements to insurance companies and
attorneys, and testimony in any tribunal shall be compensated
separately and according to a schedule of fees maintained by the
appraiser particularly for such services.
The appraiser shall not be required to give testimony or to attend
court solely by reason of this appraisal unless suitable scheduling
and fee arrangements are made in a timely fashion.
Neither the report nor any part of it shall be conveyed to any party
nor published in any venue without prior written consent of the
appraiser. The report is to be used solely for ____________________

The appraiser is neither an attorney nor accountant and assumes no
liability for such matters, except as specifically described in this
report. This report is made solely to estimate the value of the

The appraiser shall make no disclosure of the contents of this report,
except as mandated by the by-laws and regulations of the professional
organizations with which the appraiser is affiliated.
The appraisal has been prepared in conformance with the Uniform
Standards of Professional Appraisal Practice of the Appraisal
Foundation.
In the preparation of this report, the appraiser has consulted a
variety of sources, which are documented in the report or available in
the appraiser’s files. These sources are assumed to be reliable and
accurate: however, the appraiser takes no responsibility for errors or
omissions contained within them.
Any verifiable error in regard to a particular item listed in the
appraisal will be corrected and the time spent on the correction will
be at the appraiser’s expense.
The values reported in this appraisal are warranted by the appraiser
to be valid only on the effective date of the appraisal. Normal
fluctuations in the art market may affect the values stated in this
report after the effective date.
The reported analysis, opinions, and conclusions of the appraiser are
limited by the reported assumptions and limiting conditions, and are
the appraiser’s personal, unbiased professional analyses, opinions,
and conclusions.
The appraiser asserts that she has no present or prospective interest
in the property that is the subject of the appraisal and that she has
no personal interest or bias with respect to the parties involved.
By payment of the appraisal fee for this report, the parties
requesting the appraisal agree that Claudia Miller is released from
any and all liability of any kind whatsoever in any way arising from
or connected with the appraisal which he has been asked to provide.
Possession of this report does not provide title to the appraised
items. The identification of ownership is simply that represented to
me by the client or parties authorized by the client, and is not an
indication or certificate of title or ownership.
Authorized third parties may rely on the information in this report
for the defined purpose and intended use only. Third parties requiring
further information in addition to that in the report must obtain the
written permission of the owner of the appraisal before the appraiser
will discuss the report.
I have relied upon the validity of any documents, such as sales
receipts, former appraisals, and documents of authentication supplied
by the client, unless I have reason to suspect their accuracy.
Investigation of the authenticity of documents or the reliability of
information supplied by the client is beyond the scope of this
appraisal assignment. Any relevant documents supplied for
consideration after the completion of the appraisal may result in
additional charges for time and document preparation.
I will maintain your appraisal file and an electronic copy of your
appraisal document for five years, or two years after the final
disposition of any judicial proceeding in which I provided testimony.
Any information within the file will remain confidential except by
your authorization, by force of law, or for peer review.
The document must be taken as a whole, and is invalid unless all items
listed in the Table of Contents are present. The submission of the
report concludes this appraisal assignment. |
